It’s our pleasure to inform you that CDI, in Association with International Centre for Alternative Dispute Resolution (ICADR) and National Academy of Legal Studies and Research (NALSAR) University of Law, Hyderabad has initiated a Post Graduate Certificate Course in Alternative Dispute Resolution.
The resolution of disputes forms a large part of the work of the justice delivery system. India has a long tradition of resolving the disputes through conciliation methods at the village level. The Anglo Saxon legal system imposed by Britishers dismantled the indigenous dispute resolution mechanisms resulting in” docket explosion”. The courts are under pressure due to high increase in the volume of litigation and difficulties in managing the cases.
About 25 millions of cases are piled and pending in Indian courts and the number is rapidly growing. It takes several years to clear the litigations, and the delays impacts people and growth of nation and the judiciary is overburdened. Alternative Dispute Resolution (ADR) has been emerging as an effective judicial alternative worldwide and also in India. Keeping the probability of disputes in construction industry, in the field of contract, the course has been initiated.
Realising the need for speedy and effective resolution of disputes, India courts have encouraged parties to use various forms of ADR systems in an effort to produce faster and cost effective approaches to dispute resolution. The certificate course aims to develop the legal and technical expertise in conflict management including conciliation, arbitration and mediation.
In order to encourage ADR, institutions such as Lok Adults have been given statutory recognition by the Legal Service Authority Act, 1987.The Arbitration and conciliation Act, 1996 was enacted to replace the earlier legislation on Arbitration .Several new provisions have been introduced in the law of arbitration to reduce delays and expedite the process leading to the arbitral award.Concilitation has been given statutory recognition for the first time under this Act.
A new thrust has been given to settlement of disputes by ADR methods by the civil procedure(Amendment)Act2002.which has, inter alia,inserted section 89 in the civil procedure code according to which wherever there exist elements of settlement in disputes, the courts may refer such disputes to arbitration,concilitation,judicial settlement including settlement through Lok Adalat or mediation.
Now a momentum is created in India to use ADR methods in most areas of legal disputes. The need of the hour is, to create an awareness of ADR methods and to prepare trained professionals in this area to be able to use alternatives to litigation. To that end, the NALSAR University of Law and the International Centre for Alternative Dispute Resolution have joined together to institute a post Graduate certificate Course in Alternative Dispute Resolution in recognition of the burgeoning demand for trained arbitrators and conciliators.

The International Centre For Alternative Dispute Resolution (ICADR), a society registered under the Societies Registration Act, 1860, is working under the aegis of Ministry of Law and Justice, Govt.of India, New Delhi The Chief Justice of India is its Patron. The ICADR was established in 1995 to propagate, promote and popularise the settlement of domestic and international disputes by different modes of Alternative Dispute Resolution. It has its head office at New Delhi and Regional Centres at Hyderabad and Bangalore, which are fully funded by the respective State Governments of Andhra Pradesh and Karnataka. It provides administrative and other support for holding conciliation, mediation and arbitration proceedings. It also under takes training/teaching in ADR and related matters.

The course shall comprise the study of Alternative Dispute Resolution methods such as Arbitration, Conciliation etc., Law relating to Arbitration, international Arbitral Oraganisation, Law of Contracts, civil Procedure, Law of Evidence, Law of Limitation and Family Law. Simulation Exercises in Arbitration and Conciliation, Project Report, and other subjects as determined from time to time. |
